DZP provides legal support to Enea Wytwarzanie in putting a new 1,075 megawatt energy unit into commission

On 19 December a commissioning report was signed for a 1,075 MW energy unit at Enea Wytwarzanie's Kozienice Power Plant.

Domański Zakrzewski Palinka advised Enea Wytwarzanie sp. z o.o. on implementation of this coal-fired energy unit with gross output of 1,075 MW, the most innovative in Europe. The coal-fired unit was constructed in Świerże Górne near Kozienice, and the investment is worth PLN 6.4 billion. Our advice involved full legal assistance to the investor at the final stage of the investment, i.e. during regulatory and trial commissioning of the new unit.

 

“We had supported the investor in formal legal aspects of its cooperation with the investment contractor since 2013. At the final stage, we participated in work to verify that the hand-over conditions for Unit no. 11 were duly met and to draft the hand-over report.” saidTomasz Darowski, Partner in DZP’s Infrastructure & Energy Practice.

The project was handled by a multi-disciplinary team at DZP comprising construction law experts: Tomasz Darowski, Jerzy Sawicki and Tatyana Koryakina, public procurement law: Katarzyna Kuźma and Wojciech Hartung, energy law: Rafał Hajduk and Grzegorz Filipowicz, with tax expert Krzysztof Dyba and insurance law expert Julita Zimoch-Tuchołka.

 

Design work on the unit started in 2008 and in 2012 a contract was signed with the project contractor – a consortium of Mitsubishi Hitachi Power Systems Europe and Polimex-Mostostal.
