12th ranking of tax advisory firms by Rzeczpospolita: Rödl & Partner ranked 6th in Poland and distinguished in the category "Prestigious win in court in CIT-related lawsuits".

 

 

The results of the 12th ranking of tax advisory firms by Rzeczpospolita have been published.

 

Rödl & Partner has been distinguished in the category "Prestigious win in court in CIT-related lawsuits". In terms of the number of tax advisers and revenues our company has reached high positions: no. 6 and no. 8, respectively. Marcin Jamroży has once again been recommended as one of the best international tax law experts.

 

The jury has assessed victorious litigations which challenge taxpayer-unfriendly interpretations of law and make the tax authorities change their approach. Our firm has won the prestigious distinction for a CIT-related lawsuit ended with a ruling of the Supreme Administrative Court (SAC) of 29 September 2017 (file no. II FSK 2541/15) concerning revenue from the establishment of a free-of-charge transmission easement. Rödl & Partner's tax advisers representing a company dealing with public water supply and sewage collection have convinced the court to reverse the advance tax ruling which was unfavourable to the company. The SAC has ruled that since the transmission easement may be established with or without a consideration, the waiver of the fee is not a transaction. Revenue arises only if a transaction, which requires a consideration by nature, is made for free. Tax authorities continue to issue unfavourable rulings in this respect. However, thanks to this breakthrough judgement taxpayers now stand a good chance of winning the case in administrative courts, says Maciej Wilczkiewicz, tax adviser and the case leader from Rödl & Partner Gliwice.
