Dentons Warsaw advises consortium successful in PKP Intercity tender

The Polish National Appeal Chamber has dismissed an appeal against the decision of PKP Intercity to accept the bid submitted by the consortium formed by Stadler Polska and Newag in the tender for the delivery of 20 electric trains and provision of maintenance services.


Four bids were submitted in this tender, worth an estimated PLN 2 billion-plus, and PKP Intercity opted for the one from the Stadler Polska/Newag consortium.

 The decision of the National Appeal Chamber, which came after an inspection of the tender procedure, opens the way for PKP Intercity to sign the contract with the winning consortium.

 “This successful outcome is the fruit of six months of effort by our public procurement team, which advised the consortium from day one of the tender procedure ― the notice of tender, the stage of queries concerning the Terms of Reference, the drafting of the bid, and, finally, in the appeal proceedings before the National Appeal Chamber. We are extremely delighted at this success, and our clients share in our delight,” said Aldona Kowalczyk, Dentons partner heading the public procurements team in the Warsaw office.

The winning consortium was represented in the proceedings before the National Appeal Chamber by Dentons’ Aldona Kowalczyk and Anna Szymańska.
