On Monday, 18 November 2013 PKP Intercity and a consortium of Stadler Polska and Newag officially signed a contract in Nowy Sącz (southern Poland) for the delivery of 20 electric trains (EZT) and provision of maintenance services.

In attendance were, among others, the management of PKP Intercity (Janusz Malinowski, President of the Management Board and Maria Wasiak, Chairperson of the Supervisory Board), management board of Newag (Zbigniew Konieczek, President of the Management Board Wiesław Piwowar, Vice-president and Bogdan Borek, management board member) and the owner of the Stadler Rail AG Group, Mr. Peter Spuhler, as well as representatives of state authorities: Andrzej Massel, Deputy Minister for rail transport, Jerzy Miller, Governor of Małopolskie province and Andrzej Czerwiński, local MP. Worth PLN 1.6 billion, it is the largest contract for the delivery of rolling stock / electric trains in Poland this year.

Dentons law firm provided comprehensive advice to the Stadler/Newag consortium at all stages of the tender, including signing of the contract. The public procurement team headed by Aldona Kowalczyk successfully represented the consortium of Stadler/Newag in appeal proceedings before the National Appeal Chamber concerning this tender, including proceedings concerning selection of the winning offer. The awarding entity received 4 offers, but the one presented by the consortium of Stadler Polska and Newag was considered the most advantageous.

“We are very pleased with the fact that our several months of collaboration with the client led to this successful outcome.  We are proud we could advise the winning consortium from day one of the tender procedure - the notice of tender, the stage of queries concerning the Terms of Reference, the drafting of the bid, and, finally, in the appeal proceedings before the National Appeal Chamber and signing of the contract with the awarding entity,” commented Aldona Kowalczyk, Dentons partner and head of the public procurement team in the Warsaw office.
